Digital Artwork Licensing Agreement

The below serves as terms and conditions of use for all digital artwork sold on www.tuesdaygracedesigns.com.

Personal Artwork Licenses

Permitted Use Term: One (1) Project

This license allows the purchaser to use the images/artwork for use personal use ONLY. This means the project/end product CANNOT be sold, used, or redistributed for profit, financial gain or promotional material of any kind.

Only the purchaser is allowed to use the images/artwork. It cannot be forwarded, sent or shared with others.

The purchaser is only allowed to use the artwork/imagery ONE time for ONE project. If you do intend to use it more than once (multiple gifts, print it for multiple people, or use it for more than one project) a commercial license must be purchased.

 

Permitted Uses:

As the purchaser, you are allowed use the images/artwork in the below fashion. The purchaser MAY:

  • Print the product as personal artwork to hang on your wall.
  • Add it to your own wedding invitations.
  • Create a gift for someone.
  • Upload the artwork to a third-party site to have a custom cocktail napkins, cups, or other goods made for your private event or for personal use.

   

Non-Permitted Uses:

The purchaser IS PROHIBITTED from using the images/artwork in the below ways. The purchaser MAY NOT:

  • Print it on promotional material with the intent to promote the sale of and good or service.
  • Use it on your website or any social media with the intent to promote the sale of and good or service.
  • Use it on packaging, in paid advertisements or anything else that suggests commercial activity.
  • Forward the artwork to another designer, friend, or vendor that does not hold a license.

 

Commercial Artwork Licenses

Permitted Use Term: Up to 500 end products*

This license allows the purchaser to use the images/artwork on behalf of a client or a project where the end product that IS BEING SOLD for profit or a financial gain, and/or where more than one (1) product is being created using the images/artwork.

Commercial license purchasers are allowed to use the images/artwork for up the 500 end products for sale or for personal use.

Only the purchaser is allowed to use the images/artwork for business purposes. It cannot be forwarded, sent, or shared with others, including with in-company employees.

 

Permitted Uses:

As the commercial purchaser, you are allowed use the images/artwork in the below fashion. The purchaser MAY:

  • Use the images/artwork in all ways a personal license may be used.
  • Use the images/artwork for multiple wedding clients.
  • Print it on multiple end products (invitations, welcome bags, t-shirts, etc.) that will be used personally or for profit.
  • Print it on promotional material with the intent to promote the sale of and good or service.
  • Use it on your website or any social media with the intent to promote the sale of and good or service.
  • Use it on packaging, in paid advertisements or anything else that suggests commercial activity.

   

Non-Permitted Uses:

The commercial purchaser IS PROHIBITTED from using the images/artwork in the below ways. The purchaser MAY NOT:

  • Sell, package or redistribute the artwork in its original form for financial gain. (e.g. You cannot download the imagery/artwork, put your logo on it and resell it as is on your website.)
  • Forward the artwork to your entire team to be used with their own clients. If multiple designers will be using the artwork, multiple commercial licenses need to be purchased.


* If you intend to use the imagery/artwork for more than 500 end products, or would like an extended commercial license, please email chelsea@tuesdaygracedesigns.com.

 

Restricted Uses for All Licenses

As both a Personal AND Commercial License Purchaser are STRICTLY PROHIBITTED from using the images/artwork in the below ways or you will be a violation of copyright and licensing. The purchaser MAY NOT:

  • Sell, sublicense, distribute or otherwise grant rights or make available for use by others all or a portion of the images/artwork in form or formats designed or intended for re-use that will allow a third party to access to the images in digital vector format, like Pdf, Ai, photoshop vector Shapes, Eps, Flash, SVG and any vector file format.
  • Sell a creation or end product that is in any way directly competitive with the original images/artwork (e.g. as a stock asset or template.)
  • Claim the images/artwork (or a modification thereof) as its own copyrighted work---the original images/artwork must be disclaimed in any copyright registration.
  • Falsely represent authorship and/or ownership of the images/artwork.
  • Use the images/artwork in pornographic, fraudulent, immoral, infringing, illegal, harassing, offensive, or defamatory material.
